TUCSON- A Tucson police sergeant comes face-to-face with the man accused of shooting him for the first time in court Thursday.

The shooting happened last November. Police say, Ricky Mendoza opened fire on Sergeant Robert Carpenter as he responded to a burglary call in midtown.

Walking out of the Superior Court building with his wife and son, Sgt. Carpenter tells News 4 Tucson he's doing fine, and he's just waiting for his doctor to release him so he can go back to work. He declined an on camera interview saying he didn't want to jeopardize the case.

Kellie Johnson is the prosecutor. "What we did was simply inform the judge there is no plea offer at this point and we set a date for a pretrial conference."

Johnson has filed a motion to combine the burglary and aggravated assault charges. "It's a question of determining what the defense position is on it and that will be discussed on Monday."

It was November 18th when investigators say Ricky Mendoza burglarized a midtown home and allegedly stole some weapons. Sgt Carpenter and officers responded a second time after the alarm went off. That's when Sgt. Carpenter was shot. Tucson police searched the area for hours looking for the suspect on the ground and in the air.

Mendoza was arrested the following evening on the burglary charges.

Last month the 26-year-old convicted felon was charged with Sgt. Carpenter's shooting.

On Monday, the 26-year-old Mendoza is scheduled for another court hearing on the burglary charges.
