Posted 5:00 PM 12/5/2012 : Metro Water taking county to court over changes to road project
TUCSON - Not only is construction work on Magee Road creating headaches for motorists and people living in the area, but now that project is kicking up legal problems as well.
Crews began working on Magee and Cortaro Farms Road between Thornydale and Oracle last February, but Metro Water says that the county and the company hired to design the project changed the plans six months later without informing Metro Water about those changes.
Metro Water claims those last -minute changes cost them more than one million dollars. They have now filed a legal complaint against Pima County and AECOM, the design company, claiming negligence and breach of contract.
The complaint states that the county and AECOM had a duty to inform Metro Water of the changes and that they "breached this duty by failing to use reasonable professional skill, care, and diligence consistent with professional and industry standards and practices in failing to timely inform Metro Water of the changes to the projects design plan."
Both Pima County and AECOM declined to comment.
