Posted 9:15 PM 9/15/2013 : News 4 Tucson Investigators follow-up: Homeowner Hell
The News 4 Tucson Investigators followed-up on our report about a homeowner whose house is falling apart.
The walls are cracking, the foundation is sinking, and the damage keeps getting worse.
On top of that, the homeowners insurance company initially refused to cover the worst of the damage to the crumbling house.
The homeowner is former KVOA Sports Director Dan Ryan, now a public relations executive.
Ryan showed us new cracks in walls and foundations on the east side of his house, which earlier appeared undamaged.
He said the entire house should be leveled, and rebuilt.
Contractors told Ryan that a burst polybutelene pipe leaked for days, causing the foundation to sink and crack. That caused walls to crack, the roof to shift, and the damage now seems to stretch all the way out from the house to the walls around the home.
Ryan said, "I think it was described best by my general contractor who said your house is being tugged and pulled away. and that torquing is really creating the further damage in the house."
When Ryan's insurance company, American Family Insurance, denied his major damage claim weeks ago, they said his policy excludes damage from earth movement, aggravated by subsidence.
So, Ryan hired an attorney.
He said 'American Family' agreed to meet with them, and they've discussed a proposal by ‘Am-Fam' to rebuild two-thirds of the house, and leave the rest standing.
Ryan said that won't work now, with the entire house compromised. He also says he's waiting for 'Am-Fam' inspectors to come see the newest damage.
The News 4 Tucson Investigators contacted American Family Insurance, and they sent us this statement:
"What happened to the Ryans' home is unusual, complicated and unfortunate, and American Family is doing what we can to help them.
American Family made an initial payment to the Ryans for water damage to their home, including new flooring, paint, drywall, stucco and the costs associated with drying out the home.
After obtaining and evaluating new information on the claim, we decided to pay for additional damages, and shared that news with the Ryans in early August. We are also paying for additional living expenses during the repair process.
Since that time, we have worked with the Ryans' attorney, as well as third-party engineers, to confirm the appropriate repairs and cost. In partnership with the Ryans and their attorney, we hope to complete that process soon."
For now, Ryan and his wife have moved-out of the house.
